General Terms and Conditions
1. Area of application
1.1 The terms and conditions of Best Gadgets 4 All LTD, holder Frank Bernhardt, apply to all contracts between the customer and the seller respective the merchandise and / or services purchased on the online marketplace www.bestgadgets4all.co.uk.
Hereby the inclusion of the customer’s conditions is objected, if not agreed otherwise.
1.2 Customer, respective point 1.1, are consumers as well as entrepreneurs whereby a consumer is defined as a natural person who finalises a transaction for a purpose not related to professional activity.
An entrepreneur is every natural or corporate entity acting, at the time finalising a transaction, in line with professional or commercial activity.
If the customer is a natural person he has to be of age 18 or higher.
2. Conclusion of contract

2.1 The following provisions apply to all orders placed within the online marketplace www.bestgadgets4all.co.uk.

2.3 The presentation of merchandise in the internet shop is not a legally binding contract offer, but an invitation to possible customers to purchase our merchandise. With placing an order the customer is making a binding offer to conclude a purchase contract.
On receipt of an order a system generated email will be sent to the customer. With this email Best Gadgets 4 All LTD confirms the closing of the contract.
2.4 In order to make a legally binding offer in the internet shop the customer has to successfully complete the following procedure:
1) Selecting the desired merchandise
2) Confirming the selection by clicking the button “Add to cart” or clicking the button “PayPal Check out” (In case of checking out via PayPal the points 3 to 6 do not apply)
3) Verification of the content in the cart
4) Confirming by clicking the button “Checkout”
5) Either creating an account, signing in with an existing account or filling out the form for instant checkout
6) Verification of the input data
7) Choosing the preferred method of payment
8) Dispatching the order by clicking the button “Buy now”
2.5 Possible input errors whilst placing an order can be corrected using the Change functions before dispatching the order.
Another possibility to correct input errors is using the navigation keys of the browser to return to the previous page.
Closing the browser will cancel the process.
2.6 It is the responsibility of the customer to make sure that the given email address is valid, so the seller’s emails can be received. In particular the customer has to make sure that emails send by the seller can pass existing spam filters.
2.7 Storage of the text of the contract whilst ordering in the internet shop
With the confirmation email the customer receives, in addition to the order details, a copy of the terms and conditions. Additionally the terms and conditions can be read on www.bestgadgets4all.co.uk under “Terms and Conditions” at any given time.
For security reasons the order details will not be available via internet.
3. Return policy
The Customer has the right to withdraw from the contract without giving any reasons within a period of thirty days.
This period begins on the day when the customer or a third party assigned by the customer, who is not the carrier, takes possession of the merchandise.
To exercise your right of return the customer has to inform the seller with an explicit statement of the decision to withdraw from the contract, using telephone, email or mail.

The notification is considered to have been made if it was sent within the 30 days period.
If the costumer withdraws from the contract, the customer is entitled to a refund of all payments made (including shipping costs, not extending the cost of our standard shipping procedure). The customer will receive a return label. In case the purchase exceeded £20 this return label comes free of charge. Payments will take place within a period of 30 days after the seller gets notice of the withdrawal. For the refund Best Gadgets 4 All will use the same payment channel as the one used for the original transaction, unless both parties agree otherwise.
The refund can be withhold until Best Gadgets 4 All received the merchandise or the customer can prove that it was sent back to the address provided above, whichever comes first.
The customer is advised to send the merchandise back immediately, at the latest within thirty days, after sending the notice of withdrawal. The date of shipment shall evidence adherence to the time limit.
The customer bears the immediate costs of the return of the merchandise. Besides that, there will be no additional costs in the course of the refund.
In case a revision of the merchandise shows that the merchandise was compromised in quality, functionality and / or properties caused through inappropriate handling on the customer’s side, the customer will be held responsible for the loss of value.
4. Prices and conditions of payment
4.1 The prices advertised by the seller are final prices including taxes.
In case of arising expenses due to delivery costs these cost will be included in the description of the item in question.
4.2 The only accepted payment methods are the ones displayed to the customer during the process of ordering.
4.3 The title to the goods shall remain vested in Best Gadgets 4 All Ltd until the purchase price for the goods has been paid in full and the price has been received by Best Gadgets 4 All Ltd.
4.4 Best Gadgets 4 All Ltd takes reasonable care to ensure that the prices of products are correct at the time when the relevant information was entered onto the system. If an error is in the price of the products the customer ordered is discovered, Best Gadgets 4 All Ltd will inform the customer about that error. The customer has the choice to either continue the purchase at the correct price or to cancel the order. The order will not be processed further until the customer has given instructions how to proceed further. If the customer cannot be contacted by Best Gadgets 4 All Ltd using the given contact details, the order will be cancelled.
5. Conditions of delivery and shipment
5.1 The normal method of delivery is shipping to the address provided by the customer.
5.2 In case of the customer being a consumer Best Gadgets 4 All Ltd bears the risk of shipment regardless of the method of shipping.
In case of the customer being an entrepreneur all the risk and danger of shipment is taken over by the customer as soon as the merchandise is handed over to the logistics provider chosen by Best Gadgets 4 All.
6.1 The warranty claim in case of faults or deficits is based on the EU guidelines 2011/83/EU and the guidelines 1999/44/EG of the European Parliament. The use of these guidelines is in agreement with the “Consumer Rights Acts” October 2015 and only applies to consumers.
6.2 Best Gadgets 4 all LTD is liable to deliver contract-compliant merchandise.
6.3 The customer has the right to decline the merchandise within a 30 days period and to withdraw from the contract. The consequence is a refund of already made payments (for more information see 3. Revocation).
6.4 In case the customer receives merchandise in a defective condition the customer can choose between replacement and repair of the merchandise. If this does not resolve the issue, the customer can demand a partial / full refund or the customer can withdraw from the contract. The path of action is the customer’s choice with the exception of unreasonable repair costs. In this case Best Gadgets 4 All LTD can opt for a replacement of the merchandise.
6.5 The warranty expires if the customer has modified the merchandise.
6.6 Damages caused by external influences (damages caused by water, mechanical damage or crashes) are not covered by the warranty. If the damage is not covered by the warranty, it may be that we will send you a cost estimate or reject the warranty repair completely.
6.7 The burden of proof
If the fault of the merchandise occurs within the first six months the burden of proof lies with Best Gadgets 4 All. After that point of time, until the end of the six years warranty period, the burden of proof lies with the customer.
7.1 The privacy of the customer is protected by the “Data Protection act 1998” and the “Privacy and Electronic Communications Regulations 2003”.
7.2 All data provided by the customer is exclusively collected, processed, provided to commissioned partners and utilised insofar as necessary to fulfill the contract and for future business between the customer and Best Gadgets 4 All LTD.
In connection with sales and distribution of batteries Best Gadgets 4 All LTD is bound to indicate the following:
Batteries must not be disposed into household garbage. Every consumer is obligated by law to return used batteries. Batteries can be returned to the shop or can be disposed at the municipal collection point for waste.
Batteries which contain hazardous substances are marked with a crossed out dustbin. The chemical identification of the substances can be found in proximity of the dustbin symbol (e. g. Cd = Cadmium, Pb = lead, Hg = mercury).
9. Waste electrical and electronic equipment (WEEE)
If the customer buys a new electrical item, the old one and any other small electricals will be recycled for free by Best Gadgets 4 All LTD.
9.1 Why recycle?
Unwanted electrical equipment is the UKs fastest growing type of waste.
Many electrical items can be repaired or recycled, saving natural resources and the environment. If the people do not recycle, electrical will end up in landfill where hazardous substances will leak out and cause soil and water contamination – harming wildlife and also human health.
9.2 Best Gadgets 4 All LTD is pleased to offer its customers the chance to recycle their old electrical items when purchasing a new item from Best Gadgets 4 All LTD.

As a reminder that old electrical equipment can be recycled, it is now marked with a crossed-out wheeled bin symbol. The customer should under no circumstances throw any electrical equipment (including those marked with the crossed-out wheeled bin symbol) in a bin.
9.3 What is WEEE?
The Waste Electrical or Electronical Equipment (WEEE) Directive requires countries to maximise separation collection and environmentally friendly processing of these items. In the UK, distributors (including retailers) must provide a system which follows all customers buying new electrical equipment the opportunity to recycle their old items free of charge. Those establishing their own take-back scheme must as a minimum offer all customers buying new electrical equipment free take back of their old electricals on a like-for-like basis.
Additionally, where store space allocated to electricals is over 400m² distributor must offer free take back for all small electricals or they support the national network of WEEE recycling centres established by local authorities.
10. Applicable law
10.1 For the privity of contract between the parties the applicable law is the Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgements in civil and commercial matters. In case of the customer being a consumer this choice of applicable law does not negate the protection of the customer by mandatory national law of the state of which the consumer is a resident. The United Nations Convention on Contracts for the International Sale of Goods is excluded.
10.2 In the case that the customer is a business owner, legal entity under public law or special fund under public law the place of jurisdiction regarding all disputes respective this contract is the registered office of the seller. The right to turn to another court at another registered office is not affected by these provisions.

12. Severability clause
Should individual terms of this Terms and Conditions document be ineffective or lose their effectiveness because of later circumstances or should a loophole emerge in this agreement, the legal effectiveness of its other provisions is not affected.
